IN MID-FEBRUARY 2005, a then 28-year-old male clerk in a textile factory requested some time off to undergo medical tests. He had been complaining of feeling weak.

The tests revealed that the man, only identified by the initials AP in court, had developed Aids. He phoned his employer to inform him of the diagnosis and was told he could take extra leave before returning to work.

When he later returned to his job, however, his employer informed him that he was being dismissed because his co-workers said they would refuse to work with him in the same room for fear they could contract the virus that causes Aids.

Indeed, his fellow employees made written submissions to their boss, demanding the company safeguard their health by sacking the man.
